3. SUBJECT

The subject of this Preliminary Information Form is to inform the Buyer, in accordance with the provisions of the Law on the Protection of Consumers No. 6502 and the Regulation on Distance Contracts published in the Official Gazette dated November 27, 2014 and numbered 29188, regarding the sale and delivery of the product(s) specified below with their characteristics and sales price.

5. DELIVERY TIME OF THE GOODS/SERVICES

Delivery shall be made as soon as possible after stock availability and the transfer of the price of the goods to the Seller’s account. Delays may occur due to force majeure such as natural disasters or adverse weather conditions. The Seller undertakes to deliver the goods/services within thirty (30) days from the order date.

6. DELIVERY OF GOODS/SERVICES

Delivery of goods/services is made to the Buyer at the address requested by the Buyer. If the Buyer requests delivery to another person or another address, delivery will be made accordingly. Delivery costs belong to the Buyer. If the Seller has declared on the website that delivery costs will be covered by the Seller for purchases over a certain amount or in specific campaigns, the delivery cost will be borne by the Seller. Delivery of goods/services is carried out by courier companies.

For the delivery of the goods/services subject to the order, it is a condition that a signed copy of the distance sales contract is sent to the Seller and that the price is paid using the payment method chosen by the Buyer. If, for any reason, the price of the goods/services is not paid or is canceled in bank records, the Seller shall be deemed released from its obligation to deliver the goods/services.

7. PAYMENT METHOD

Payments can be made via credit card, wire transfer (EFT), or bank transfer.

8. VALIDITY PERIOD

The listed and announced prices on the website are the sales prices. The announced prices and promises remain valid until updated or changed. Prices announced for a limited period remain valid until the end of the specified period. However, in case of incorrectly stated prices due to error or delayed updates from the supplier, the updated price notified by the Seller shall be deemed valid. If an overcharge has been made, the difference will be refunded. If the actual price of the goods/services differs from the announced price, the Buyer will be informed of the actual price. At the Buyer’s request, the sale may be carried out at the actual price, or the sale may be canceled.

9. RIGHT OF WITHDRAWAL

In distance contracts regarding the sale of goods, the Buyer has the right to withdraw from the contract by refusing the goods within fourteen (14) days from the date of receipt, without assuming any legal or criminal liability and without providing any justification. In distance contracts regarding the provision of services, this period starts from the date the contract is signed. If it has been agreed in the contract that the performance of the service will begin before the expiry of the fourteen-day period, the consumer may exercise the right of withdrawal until the date on which the performance begins. Costs arising from the use of the right of withdrawal belong to the Seller.

To exercise the right of withdrawal, the Buyer must notify the Seller via fax, telephone, or electronic mail within fourteen (14) days. The goods/services must be undamaged while being tested and in resalable condition according to Article 4 of the Distance Sales Contract and the preliminary information published on the Seller’s website, which forms an integral part of this Agreement. The return procedures under the right of withdrawal are specified in the Distance Sales Contract. In the event that this right is exercised, the original invoice related to the goods/services delivered to the Buyer or a third party must be returned. Within a maximum of fourteen (14) days following the receipt of the withdrawal notice, the price of the goods/services and delivery expenses will be refunded to the Buyer. The Buyer is obliged to return the goods/services within ten (10) days. If the original invoice is not sent, VAT and other legal obligations cannot be refunded to the Buyer. Delivery costs of goods/services returned under the right of withdrawal shall be borne by the Buyer.

If the value of the goods decreases due to reasons attributable to the Buyer or if the return becomes impossible, the Buyer is obliged to compensate the Seller for the loss in proportion to the Buyer’s fault. Payments can be made via credit card, EFT, or bank transfer.

10. GOODS/SERVICES FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

The right of withdrawal cannot be exercised for goods/services that, by their nature, cannot be returned, goods/services that perish quickly or have expired, disposable goods/services, or any kind of software and programs that can be copied. In addition, in order for the right of withdrawal to be exercised for software and programs, DVDs, DIVX, VCDs, CDs, MDs, videocassettes, computer and stationery consumables (toner, cartridges, ribbons, etc.), and cosmetic materials, the packaging of the goods/services must be unopened, undamaged, and unused.

Specifically:

  • Contracts regarding goods or services whose price depends on fluctuations in financial markets and which are not under the control of the seller or provider.
  • Contracts regarding goods prepared according to the consumer’s requests or personal needs.
  • Contracts regarding the delivery of goods that may perish quickly or whose expiration date may pass.
  • Contracts regarding the delivery of goods that are unsuitable for return for reasons of health and hygiene, where protective elements such as packaging, tape, seal, or package have been opened after delivery.
  • Contracts regarding goods that are mixed with other products after delivery and which, by nature, cannot be separated.
  • Contracts regarding books, digital content, and computer consumables presented in a physical medium, if the packaging has been opened after delivery.
  • Contracts regarding periodicals such as newspapers and magazines, other than those provided under a subscription agreement.
  • Contracts regarding accommodation, transportation of goods, car rental, food and beverage supply, and leisure activities to be carried out on a specific date or period.
  • Contracts regarding services performed instantly in electronic environment or intangible goods delivered instantly to the consumer.
  • Contracts regarding services where performance has begun with the consumer’s consent before the withdrawal period has expired.

11. VALIDITY

This preliminary information form must be read and accepted electronically by the Buyer before proceeding to the stage of concluding the Distance Sales Contract.

12. COMPETENT COURT

For complaints and objections, the consumer may apply to the consumer arbitration committee or consumer court located in the place where the consumer purchased the goods/services or where the consumer resides, within the monetary limits determined annually in December by the Ministry of Customs and Trade of the Republic of Turkey.

13. FINAL PROVISIONS

If it is determined that the documents and information provided for the order are incomplete, false and/or inaccurate, or if there is suspicion or evidence that the order was placed in bad faith and/or for commercial or profit-making purposes, the Seller reserves the right to suspend and/or cancel the order application at any time, provided that the Buyer is informed. In case of cancellation, the refund process for the payment may be carried out provided that the Buyer is informed.

14. EXCEPTION

The provisions of this Preliminary Information Form, which derive from the Law No. 6502 on the Protection of Consumers and provide legal protection to consumers, shall be valid only in cases where the Buyer qualifies as a Consumer. In cases where the Buyer does not fall under the definition of Consumer as per Law No. 6502, the relevant provisions shall not be effective between the parties.

The Buyer hereby acknowledges, declares, and undertakes that he/she has read the Preliminary Information in accordance with Article 48/2 of Law No. 6502 and Articles 5, 6, and 7 of the Regulation on Distance Contracts, has been informed, and has given the necessary confirmation electronically.
